RULES AND REGULATIONS FOR the "Who Is Lulu? Contest"
All entries into the RufusWainwright.com "Who Is Lulu? Contest" (the "Contest”) are bound by the following rules and all winners must consent to the use their names, cities of residence, photographs, voice, likeness and/or images for publicity purposes in all media carried out the by RufusWainwright.com, without payment or compensation of any kind, in order to receive their prizes.
1. Eligibility
No purchase necessary to enter. This Contest is open to residents of Canada, excluding Quebec, and the United States of America, excluding all employees (current or retired) of RufusWainwright.com , their subsidiaries, related and affiliated companies, agents and advisors (the "Sponsors"), and their immediate families and those with whom they are domiciled. Prize winners must be over the age of 21 to claim their prize.
2. How to Enter the Contest
To enter the Contest, entrants must send an email to contests@RufusWainwright.com. This email must contain the answer to the question "Who Is Lulu?". Only correct answers will be entered into the draw. All entries must be received before the Entry Deadline. The Contest starts on 12 noon EST on Tuesday, March 9, 2010.
3. Entry Deadline
To be eligible to attend the show, entries must be received by 5 pm EST on Friday, March 12, 2010. All entries shall become the property of the Sponsors and as such will not be returned.
4. The Prizes
The winner and a guest will attend a special private concert by Rufus Wainwright in New York City on March 15, 2010. Winner must provide transportation to and from the event and is responsible for any other costs associated with attending.
5. The Winners
A random draw to determine the winner(s) will take place at the Sponsor's Head Office on the morning of March 15, 2010. The winner is considered the holder of the email account that was submitted into the Contest. The Sponsors will attempt to notify the selected entrant by telephone. If the winner cannot be contacted by noon on March 15, or does not meet all of the Contest conditions, another entry will be selected from all remaining eligible entries. Winner(s) must cover all other costs associated with the prize including, but not limited to, transportation, accommodation and other taxes, fees and expenses related to the Contest. The decision of the Contest judge is final.
6. Limitation of Liability
By accepting the prize, the winner releases and indemnifies the Sponsors and officers, directors, shareholders, employees, advisors, assignees, agents, licensees and representatives from any and all liability arising out of, pursuant to, or as a result of the carrying out of the Contest (including liability arising from the acceptance of and participation in any prize) and confirming compliance with Contest rules prior to acceptance of any prize. Sponsors shall not be responsible for any lost, misdirected, damaged or destroyed prizes.
7. Other
The Contest is governed by the laws of Ontario and the laws of Canada applicable therein. This Contest is void where prohibited by law. The Sponsors reserve the right to cancel or modify this Contest or the Contest rules at any time without notice. All prizes must be accepted as awarded, are non-transferable and are not convertible to cash. The Sponsors reserve the right to substitute any prize or portion of the prize with a prize of equal or greater value. All prizes are awarded as-is and no warranties or guarantees are implied or expressed. The odds of winning depend on how many eligible entries are received. Sponsors are not liable for any lost or stolen entries or inability to process entries, or any errors, damage or negligence that may arise in connection with this Contest, including technical failures on the part of Contest software, virus, website down-time, human error or property damage incurred by any Contest entrant.
